This Acceptable Use Policy ("AUP") is incorporated into and is part of the Ice9.ai Terms of Service. This policy defines prohibited uses of the Ice9.ai image analysis service. Violations of this AUP may result in immediate account suspension or termination, reporting to authorities, and legal action.
1. Purpose and Scope
The purpose of this AUP is to: - Protect the rights and safety of individuals whose images may be analyzed - Prevent illegal or harmful uses of the Service - Maintain the integrity and security of our platform - Comply with applicable laws and regulations - Protect the Ice9.ai community
This AUP applies to all users of Ice9.ai, including: - Free Demo users - Paid API customers - Enterprise customers - Trial users - Any person or entity accessing the Service
2. Prohibited Content
You may NOT upload or process images that contain:
2.1 Child Exploitation Material
STRICTLY AND ABSOLUTELY PROHIBITED: - Child sexual abuse material (CSAM) - Images of minors in any sexual, suggestive, or exploitative context - Images of minors in any state of undress - Sexualized depictions of minors, including digitally altered or AI-generated images - Content that sexualizes, grooms, or otherwise exploits children
This prohibition is absolute. Any violation will result in: - Immediate and permanent account termination - Report to the National Center for Missing & Exploited Children (NCMEC) - Report to the FBI and appropriate law enforcement - Full cooperation with criminal investigations - Possible civil and criminal liability
2.2 Non-Consensual Intimate Images
- Intimate or sexual images shared without the consent of the depicted individual(s)
- "Revenge porn" or non-consensual pornography
- Deepfakes or digitally altered intimate images without consent
- Upskirt, downblouse, or other voyeuristic images
- Hidden camera images of individuals in private settings
2.3 Illegal Content
- Images depicting or promoting illegal activities
- Images of illegal weapons, drugs, or contraband
- Images promoting or depicting violence, torture, or cruelty
- Images depicting actual crimes in progress
- Counterfeit documents or currency
- Material that violates any applicable local, state, federal, or international law
2.4 Hateful or Discriminatory Content
- Images promoting hate speech against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Nazi symbols, Confederate flags in hateful contexts, or other symbols of hate groups
- Content promoting white supremacy, extremism, or terrorism
- Images designed to harass, threaten, or intimidate individuals or groups
2.5 Violent or Graphic Content
- Gore, mutilation, or graphic violence
- Images of deceased individuals (except in news/historical contexts)
- Animal abuse or cruelty
- Self-harm or suicide-related imagery
- Graphic medical or surgical content (except for legitimate medical/educational use)
2.6 Explicit Sexual Content
While adult consensual sexual content is not prohibited per se, the following restrictions apply: - All individuals depicted must be verifiably 18 years of age or older - All individuals must have consented to the creation and processing of the image - Content must not violate any laws (obscenity, prostitution, etc.) - Content must comply with Section 2.2 (consensual images only)
We reserve the right to refuse service for processing adult sexual content if we determine usage patterns suggest risk.
3. Prohibited Uses
You may NOT use Ice9.ai to:
3.1 Privacy Violations
- Process images of individuals without their knowledge and consent
- Track or surveil individuals without authorization
- Create databases of individuals' biometric or physical characteristics without consent
- Process images captured from security cameras monitoring private spaces without consent
- Aggregate data about individuals for stalking, harassment, or discrimination
3.2 Unauthorized Facial Recognition or Identification
- Build facial recognition systems to identify individuals without their explicit consent
- Create databases matching faces to identities without authorization
- Use the Service for mass surveillance or monitoring of public spaces
- Identify individuals for discriminatory purposes
- Match faces to sensitive categories (religion, health status, sexual orientation, etc.)
Exception: Law enforcement use with proper legal authorization may be permitted under separate agreement.
3.3 Discriminatory Decision-Making
Use Ice9.ai analysis results to make decisions about individuals regarding: - Employment, hiring, or termination - Credit, lending, or financial services - Insurance eligibility or pricing - Housing or rental applications - Educational admissions - Healthcare access or treatment - Law enforcement profiling
Unless you have implemented appropriate safeguards, bias testing, human review, and compliance with anti-discrimination laws (e.g., Fair Credit Reporting Act, Fair Housing Act, Equal Employment Opportunity laws).
3.4 Deceptive or Fraudulent Purposes
- Create misleading or deceptive content
- Fabricate evidence for legal proceedings
- Manipulate analysis results to support false claims
- Use the Service to commit fraud or identity theft
- Circumvent age verification or identity verification systems
3.5 Competitive Intelligence
- Analyze Ice9.ai's own website, documentation, or materials to reverse engineer our service
- Build competing services or products based on our API
- Extract training data to develop competing AI models
- Systematic analysis of our competitors' products on our platform
3.6 Security and System Abuse
- Probe for vulnerabilities or security weaknesses
- Attempt to bypass rate limits, access controls, or authentication
- Submit malformed or malicious images designed to exploit system vulnerabilities
- Conduct denial-of-service attacks or excessive load testing
- Attempt to access other users' data or accounts
- Reverse engineer our AI models or algorithms
3.7 Spam and Bulk Abuse
- Submit large volumes of duplicate or near-duplicate images without legitimate purpose
- Use the Service for unsolicited commercial purposes (spam)
- Create fake accounts or use the Service in coordination with multiple accounts to circumvent limits
- Automated bulk processing without proper API access
3.8 Intellectual Property Infringement
- Process copyrighted images without authorization from the copyright holder
- Use the Service to facilitate copyright infringement or piracy
- Process trademarked materials for counterfeiting purposes
- Violate others' publicity or personality rights
4. Content Moderation Responsibilities
4.1 Your Responsibilities
When using Ice9.ai's content moderation features: - You are solely responsible for determining how to use the returned coordinate data - Content moderation features are tools to assist you, not absolute guarantees - You must implement your own review processes appropriate to your use case - You must comply with all applicable content moderation laws in your jurisdiction
4.2 Limitations
Our content moderation features: - Are not 100% accurate (false positives and false negatives occur) - May miss certain types of prohibited content - May flag appropriate content incorrectly - Should not be relied upon as the sole safeguard against prohibited content
4.3 High-Risk Use Cases
If you are using Ice9.ai for high-risk content moderation (e.g., moderating user-generated content on a platform with millions of users), you must: - Implement multiple layers of protection beyond our API - Include human review for flagged content - Have clear policies and appeal processes - Comply with applicable platform liability laws (e.g., DMCA, Section 230)
5. Consent and Authorization Requirements
5.1 Individual Consent
You must obtain appropriate consent from individuals depicted in images before processing, except where: - You are the individual depicted (self-analysis) - Processing is for legitimate public interest purposes (news, research with IRB approval) - Images are from public domain or licensed sources with model releases - Processing is legally authorized (law enforcement with warrant)
5.2 Documented Consent
For commercial applications processing images of others, you should maintain: - Signed consent forms or agreements from depicted individuals - Model releases for commercial use - Records of consent for at least 3 years - Clear disclosure of how images will be analyzed and used
5.3 Consent Withdrawal
If an individual withdraws consent: - You must cease processing images of that individual - Delete any stored analysis results related to that individual - Notify us if required by contract
6. Biometric Privacy Laws
6.1 Illinois BIPA Compliance
If processing images of Illinois residents, you must comply with the Illinois Biometric Information Privacy Act (BIPA): - Provide written notice before collecting biometric data - Obtain written consent - Publish data retention and destruction policies - Not sell, lease, or trade biometric data
6.2 Other State Biometric Laws
Similar laws exist or are pending in other states. You are responsible for compliance.
6.3 GDPR Biometric Data
Under GDPR, biometric data is "special category" personal data. Processing requires: - Explicit consent, OR - Legal basis under GDPR Article 9(2) - Appropriate safeguards and data protection impact assessment
7. Acceptable Use Cases
To clarify, the following uses ARE generally permitted (when done lawfully and ethically):
7.1 Personal Use
- Analyzing your own photos
- Organizing personal photo libraries
- Creating personal applications for friends and family with consent
7.2 Commercial Applications
- E-commerce product image analysis
- Content moderation for user-generated content platforms (with proper safeguards)
- Accessibility tools (image description for visually impaired)
- Inventory management and cataloging
- Quality control and defect detection
- Retail analytics (foot traffic, shelf monitoring with disclosure)
7.3 Creative and Educational
- Art and photography analysis
- Educational research with IRB approval
- Historical photo archiving and cataloging
- Museum and library digitization projects
7.4 Safety and Security
- Workplace safety monitoring (with notice and consent)
- Property security (with proper notice and privacy safeguards)
- Lost and found systems
- Parental monitoring of minor children (by legal guardian)
7.5 Research and Development
- Academic research with IRB approval
- AI model testing and evaluation
- Benchmark development
- Scientific studies
7.6 Healthcare and Medical (Non-Diagnostic)
- Medical education
- Wellness and fitness tracking (with consent)
- Telemedicine support (not as sole diagnostic tool)
Note: Ice9.ai is NOT HIPAA-compliant and should not be used to process Protected Health Information (PHI) without appropriate safeguards.
8. Enforcement and Reporting
8.1 Monitoring and Detection
We reserve the right to: - Monitor API usage patterns for abuse - Review flagged content or accounts - Use automated systems to detect violations - Request additional information about your use case
8.2 User Reporting
Users may report violations to: abuse@ice9.ai
Include: - Description of violation - Evidence (URLs, screenshots, request IDs if applicable) - Your contact information
All reports will be reviewed confidentially.
8.3 Investigation
Upon receiving a report or detecting potential violations: - We will investigate within 3 business days - May temporarily suspend account during investigation - May request information from the accused user - Will make a determination based on available evidence
8.4 Enforcement Actions
Depending on severity, violations may result in:
Minor Violations: - Warning - Request to cease specific activity - Temporary rate limit reduction
Moderate Violations: - Temporary account suspension (7-30 days) - Removal of specific content or analysis results - Mandatory review of use case before reinstatement
Severe Violations: - Immediate and permanent account termination - No refund of fees paid - Report to law enforcement (if illegal) - Report to NCMEC (if child exploitation) - Potential civil or criminal legal action
8.5 Zero Tolerance Violations
The following result in immediate permanent termination: - Any child exploitation material (CSAM) - Non-consensual intimate images - Use for stalking or harassment - Building discriminatory facial recognition systems - Fraudulent or criminal activity
8.6 Appeals
If your account is suspended or terminated for violations other than zero-tolerance offenses, you may appeal to: appeals@ice9.ai
Include: - Account email - Reason for appeal - Evidence supporting your position
We will review appeals within 10 business days. Our decision is final.
9. Legal Reporting Obligations
9.1 CSAM Reporting
We are legally required to report apparent child sexual abuse material (CSAM) to NCMEC. We will also report to appropriate law enforcement.
9.2 Law Enforcement Cooperation
We cooperate with lawful law enforcement requests, including: - Subpoenas - Court orders - Search warrants - National security letters
9.3 Voluntary Reports
We may voluntarily report to law enforcement: - Threats of violence or harm - Ongoing criminal activity - Terrorism-related content - Other serious crimes
10. Changes to This Policy
We may update this AUP from time to time. Changes will be effective upon posting, and we will notify users of material changes via: - Email notification - Notice on our website - Update to "Last Updated" date
Continued use of the Service after changes constitutes acceptance of the updated AUP.
